Chapter 7 bankruptcy is the mostly frequently filed case.  It is referred to as a liquidation case meaning that any non-exempt assets get liquidated to pay creditors.  Most Chapter 7 debtors have no non-exempt.  In Idaho most folks can keep their home and their cars in bankruptcy, so long as, they keep their payments current. A married couple can also keep up to $15,000 worth of household goods and two vehicles with no more than $7,000 equity in each.  There is also a $100,000 exemption that is allowed for your home. To be eligible for a Chapter 7 bankruptcy you must be able to show the Court that you cannot pay your bills as they normally become due.  If so, and so long as you do not earn more money than is required for normal living expenses you are eligible.

In a Chapter 7 bankruptcy you cannot normally eliminate student loans, back taxes, child support or criminal restitution. Most other debts including medical debts and credit cards are typically discharged.
