He has also obtained outright dismissals on various types of charges including:

Armed Robbery, Drug Trafficking, Domestic Battery, Theft, Possession of a Controlled Substance, DWP, Shoplifting, . . . and so forth.

As a criminal defense lawyer/attorney Rocky handles all types of juvenile, misdemeanor, and felony cases. Call now for a free phone consultation!

*It should be noted that every case is unique and the majority of cases are resolved by a plea agreement.  The decision to go to trial should only be made after careful consideration of the circumstances of each particular case w/ an experienced criminal defense attorney.

A few recent victories:

Multiple Felony Possession Counts-Dismissed!
This client had been stopped on a highway convenience store when the police approached him and started interrogating he and his buddy for forty plus minutes.  Even though he had eventually confessed to felony possession of drugs and drugs were found in the car, the charges were ALL dismissed.  Why?  Because the Court suppressed the evidence because the officer questioned him for more than forty minutes without reasonable suspicion!

Aiming a firearm at another-Dismissed!  This man was charged with aiming his pistol at another person after he had ran into his home, pulled out a pistol, and fired it.  Why?  Because just prior to retrieving his weapon the "victim" had beat the Defendant severely on the front porch of his own home and continued to threaten the Defendant.  While use of deadly force is the most extreme of situations this reinforces the legal rule that if someone is committing violence against you in your own home there are some situations where deadly force is authorized.

Possession of Marijuana-Dismissed! Prosecutor was forced to dismiss this charge despite the fact that the Defendant readily handed over the marijuana directly to the officer. Why? Because the officer's violated the Defendant's Fourth Amendment rights when they threatened to come into his home.

Forcible Rape - Dismissed!
Court dismissed Forcible Rape at the preliminary hearing.  Why? Because the prosecutor couldn't get the "victim" to testify against her two alleged "attackers" consistently with what she had told the police before.

Drug Trafficking-
3.5 lbs. Marijuana-Dismissed!
Court granted our Motion to Suppress arguing that the police illegally detained & searched Defendant. Why? Police had made him wait on the roadside for 47 minutes all just because they thought he was acting "nervous".  Criminal defense attorney Rocky Wixom won this dismissal despite statements from the defendant that the State characterized as "confessions"!

Jury Acquittal on Aggravated Battery!  A man charged with stabbing another man 4 times with a knife causing him to be life flighted to the hospital was acquitted of all charges after two days of jury trial.  Why? Even though the State's correctly argued that you cannot normally bring a knife to a fist fight, the knife had been used only after the defendant was first "sucker" punched off of a flight of stairs. The Jury acquitted despite eyewitness testimony from the victim's grandfather.

Rape charges reduced to a non-sex felony!  After more than a year of fighting this  "she said/he said" case, the State finally reduced the charge to a non-sex felony and Defendant recieved probation, and he is NOT required to register as a sex-offender.  All this despite the fact that the victim adamantly maintained she had been forced to have intercourse and despite physical evidence.  Why? Because of two separate polygraphs finding that the Defendant simply did not have sex with the teenage victim.
